4.    Henkilötietojen käsittelyn tarkoitus ja oikeusperuste

Henkilötietojen käsittely on tarpeen Centria-ammattikorkeakoulu Oy:n

hankkeiden toteuttamiseksi.

Tuensaajan (Centria) on myös kerättävä direktiivien nojalla Euroopan rakennerahastoista osarahoitettavan hankkeen toimintaan osallistuvista henkilöistä osallistujatietoja.

Tietoja käytetään AIMlearning-hankkeen yhteistyöhön, viestintään ja tiedottamiseen, tapahtumien järjestämiseen, sekä hankkeen raportointiin, toiminnan dokumentointiin ja tilastointiin.

Kysely- ja tutkimuslomakkeiden tietoja voidaan hyödyntää myös tutkimustarkoitukseen.

Henkilötietojen oikeusperusteena on rekisteröidyn suostumus (TSA 6 artikla 1 kohdan a – alakohta).

5.    Rekisterinpitäjän oikeutettu etu

Käsittelyn oikeusperuste ei ole oikeutettu etu. Siksi tämä kohta ei

sovellu.

6.    Käsiteltävät henkilötiedot ja henkilötietoryhmät

Rekisteröityjä ovat AIMlearning-hankkeesta kiinnostuneet henkilöt ja/tai henkilöt, jotka haluavat osallistua, osallistuvat tai ovat osallistuneet hankkeen toimintaan tai tapahtumiin.

Henkilötiedot kerätään Forms-, Webropol- tai www.aimlearning.fi verkkosivujen lomakkeiden kautta.

Henkilön yksilöintitiedot:

–          Nimi

–          Yhteystiedot

Tiedot asiakkaan kiinnostuksesta hankkeeseen ja vastaukset hankkeen kyselyihin.

Hankkeen raportointi- ja tilastointitiedot, mikäli ne ovat oleellisia tapahtuman toteutuksen tai hankkeen raportoinnin kannalta, kuten esimerkiksi:

–          Paikkakunta.

–          Henkilön status: työssäkäyvä, työtön, opiskelija tai muu.

Tapahtuman järjestelyihin liittyvät välttämättömät tiedot, kuten esimerkiksi:

–          Osallistuuko tilaisuuteen paikan päällä vai etänä.

–          Tapahtuman järjestelyihin liittyvät toiveet ja tiedot, esimerkiksi työpajavalinta.

Erityiset henkilötiedot: Pyydetään vain siinä laajuudessa, kuin ne ovat välttämättömiä käytännön järjestelyiden, esteettömyyden ja saavutettavuuden kannalta.

–          Erikoisruokavaliot tai allergiat.

–          Tiedot tapahtuman järjestämiseksi esteettömästi ja saavutettavasti, esimerkiksi liikuntarajoitteet.

Henkilötietoja ei kerätä tai käsitellä laajemmin kuin on välttämätöntä käyttötarkoituksen kannalta.

7.    Säännönmukaiset tietolähteet

Henkilötiedot on saatu rekisteröidyltä itseltään.

8.    Tietojen vastaanottajat tai vastaanottajaryhmät sekä säännönmukaiset luovutukset

Centria ei myy tai muutoin luovuta henkilötietojasi Centrian ulkopuolelle. Centria voi kuitenkin luovuttaa henkilötietojasi Centrian ulkopuolelle seuraavissa tilanteissa:

Henkilötietojasi voidaan luovuttaa nimenomaisella suostumuksellasi esimerkiksi kolmannen osapuolen tarjoamaan palveluun liittyen.

Tietoja voidaan siirtää AIMlearning-hankkeen partnerien ja yhteistyökumppanien välillä, mikäli se on hankkeen toiminnan ja raportoinnin kannalta välttämätöntä:

Hankkeen rahoittaja ja valvovat viranomaiset ja heidän tietojärjestelmänsä:

Hankkeella on velvollisuus raportoida riittävät ja pyydetyt tiedot hankkeen toiminnasta ja toteutuksesta rahoittajalle. Rahoittajalla on myös oikeus tarkistaa hankkeen toimintaa ja materiaaleja. Näihin viranomaisiin tai tahoihin lukeutuvat mm. rakennerahastot, Elinkeino-, liikenne- ja ympäristökeskus, kuntarahoitus/Kokkolan kaupunki/Kosek, Euroopan komissio.

Tietoja voidaan esimerkiksi siirtää tai syöttää rakennerahastohankkeiden EURA2021 järjestelmään raportoinnin yhteydessä. Erityisiä henkilötietoja, ei kuitenkaan luovuteta eteenpäin tässä kappaleessa mainituille viranomaisille tai tiedot muutetaan anonyymiksi, siten, että vastaaja ei ole tunnistettavissa.

Henkilötietoja käsitellään järjestelmissä, joista Centrialla

on henkilötietojen käsittelysopimus artiklan 28 mukaisesti. Tällöin

henkilötietoja siirtyy palveluntarjoajalle. Tällaisia järjestelmiä ovat Microsoft O365 ympäristö ja ohjelmistot, Teams, Forms, Outlook, Webropol.

Tutkimuskäyttö:

Saatamme joissakin tapauksissa luovuttaa tietoja tieteellistä tai muuta tutkimusta varten edellyttäen, että kyseiset tiedot on ensin muutettu sellaiseen muotoon, josta yksittäiset henkilöt eivät ole enää tunnistettavissa.

Pakottavan lainsäädännön edellyttämät luovutukset:

Henkilötietojasi voidaan luovuttaa toimivaltaisen viranomaisen esittämien vaatimusten ja lakiin perustuvien edellytysten mukaisesti.

Alihankkijat ja palveluntarjoajat

Centria tai AIMlearning saattavat käyttää alihankkijoita ja palveluntarjoajia palvelujensa tekniseen ylläpitoon, asiakaspalveluun, käyttäjätietojen hallinnointiin ja analysointiin, tutkimuksiin, asiakasviestintään tai erilaisten kampanjoiden toteuttamiseen. Henkilötietojasi voidaan luovuttaa alihankkijoille ja palveluntarjoajille vain siinä määrin, kun ne osallistuvat palvelujen toteuttamiseen ja tässä tietosuojalausekkeessa kuvattujen käyttötarkoitusten toteuttamiseen.

Tällaiset kolmannet osapuolet eivät saa käyttää tietojasi mihinkään muuhun, kuin tässä tietosuojalausekkeessa kuvattuihin ja Centrian määrittämiin tarkoituksiin. Centria velvoittaa heidät pitämään tietosi salassa ja huolehtimaan asianmukaisesti riittävästä tietoturvan tasosta henkilötietojesi suojaamiseksi.

9.    Onko henkilötietojen antaminen lakisääteinen, sopimukseen perustuva tai sopimuksen tekemisen edellyttämä vaatimus sekä onko rekisteröidyn pakko toimittaa henkilötiedot ja tietojen antamatta jättämisen seuraukset.

Ei sovellu tähän käsittelyperusteeseen.

10.Henkilötietojen säilyttämisaika

ESR-rahoitus velvoittaa Centriaa tuensaajana säilyttämään kaikki hankkeeseen liittyvä kirjanpito- ja muu aineisto siten, että tuen käytön valvonta on mahdollista. Tietoja säilytetään hankkeen toiminta-aikana, sekä hankkeen päättymispäivästä laskettaen 10 kalenterivuotta. Tiedot, joita ei tarvitse raportoida tai säilyttää, poistetaan hankkeen päättyessä.

11.Tietojen siirto EU:n tai ETA:n ulkopuolelle

Henkilörekisterin sisältämiä henkilötietoja ei pääsääntöisesti siirretä EU:n tai ETA-maiden ulkopuolelle.

Centrian palveluja saatetaan kuitenkin joissakin tapauksissa toteuttaa myös muualla sijaitsevia toimijoita, palveluja ja palvelimia käyttäen, ja tällöin henkilötietojasi saatetaan siirtää eri maiden välillä. Tällaiset siirrot voivat sisältää henkilötietojen luovutuksia EU- tai ETA-alueen ulkopuolelle sellaisiin maihin, joiden henkilötietojen käsittelyä koskeva lainsäädäntö poikkeaa Suomen lain vaatimuksista, esimerkiksi Yhdysvaltoihin. Centria huolehtii tällöinkin henkilötietojesi suojan riittävästä tasosta muun muassa sopimalla henkilötietojen luottamuksellisuuteen ja käsittelyyn liittyvistä asioista lainsäädännön edellyttämällä tavalla, esimerkiksi EU:n komission hyväksymiä mallisopimuslausekkeita käyttäen ja muutenkin siten, että henkilötietojen käsittely tapahtuu tämän tietosuojalausekkeen mukaisesti.

12.Tietojen suojauksen periaatteet

Henkilötiedot on suojattu teknisillä toimenpiteillä. Käyttöoikeudet on rajattu vain niille henkilöille, joiden työnkuvaan rekisteritietojen käsittely kuuluu.

Centria voi käyttää palvelujensa toteuttamisessa ja henkilötietojen käsittelyssä myös alihankkijoita ja palveluntarjoajia. Tällöin huolehdimme sopimus- ja muilla järjestelyillä siitä, että henkilötietojasi käsitellään lainsäädännön, hyvän tietosuojakäytännön ja tämän tietosuojalausekkeen mukaisesti.

13.Automaattinen päätöksenteko ja profilointi

Henkilötietoja ei käytetä automaattiseen päätöksentekoon eikä

profilointiin.

14.Rekisteröidyn oikeudet

Tietosuojaoikeudet riippuvat siitä, millä perusteella henkilötietoja käsitellään.

Omat tiedot on oikeus saada maksutta. Jos henkilö pyytää useampia jäljennöksiä, rekisterinpitäjä voi periä niistä hallinnollisiin kustannuksiin perustuvan kohtuullisen maksun (EU:n yleisen tietosuoja-asetuksen 15 artiklan 3 kohta).

18.Purpose and legal basis for processing personal data

The processing of personal data is necessary for the purposes of Centria University of Applied Sciences projects.

The beneficiary (Centria) must also collect participant data on the persons involved in the activities of the project co-financed by the European Structural Funds under the Directives.

The data is used for the AIMlearning project’s cooperation and communication, the organisation of events, as well as for project reporting, documentation of activities and statistics.

The data in the questionnaires and survey forms can also be used for research purposes.

The legal basis for personal data is the consent of the data subject (Article 6(1)(a) of the TSA).

19.Legitimate interest of the controller

The legal basis for the processing is not legitimate interest. That is why this passage is not Suitable.

20.Processed personal data and categories of personal data

Data subjects are persons interested in the AIMlearning project and/or persons who wish to participate, are participating or have participated in the activities or events of the project.

Personal data is collected through forms on Forms, Webropol or www.aimlearning.fi website.

Individual’s identification data:

–          Name

–          Contact details

Information about the customer’s interest in the project and responses to the project’s questionnaires.

Project reporting and statistical data, if they are relevant to the implementation of the event or project reporting, such as:

–          Locality or municipality.

–          Person’s status: employed, unemployed, student or other.

Necessary information related to the organisation of the event, such as:

–          Whether to participate in the event on site or remotely.

–          Wishes and information related to the arrangements of the event, such as the choice of workshop.

Specific personal data: Requested only to the extent necessary for practical arrangements and accessibility.

–          Special diets or allergies.

–          Information to organise the event in an accessible way, such as reduced mobility.

Personal data is not collected or processed more extensively than is necessary for the purpose for which it is used.

The personal data has been obtained from the data subject himself/herself.

22.Recipients or categories of recipients of the data and regular disclosures

Centria does not sell or otherwise disclose your personal data outside of Centria. However, Centria may disclose your personal data outside Centria in the following situations:

The project is funded and supervised by the authorities and their information systems:

The project is obliged to report sufficient and requested information on the project’s activities and implementation to the funder. The funder also has the right to review the project’s activities and materials. These authorities or parties include, for example, the European Structural Funds, the Centre for Economic Development, Transport and the Environment, Municipality Financer/City of Kokkola/Kosek, and the European Commission.

For example, data can be transferred or entered into the system EURA2021 Structural Funds projects in connection with reporting. However, special personal data will not be disclosed to the authorities mentioned in this paragraph, or the data will be made anonymous, so that the defendant cannot be identified.

Personal data is processed in systems from which Centria

is a personal data processing agreement in accordance with Article 28.

Now personal data is transferred to the service provider. Such systems include the Microsoft O365 environment and software, Teams, Forms, Outlook, Webropol.

Research use:

In some cases, we may disclose information for scientific or other research, provided that such information has first been converted into a form that no longer identifies individuals.

Disclosures required by mandatory legislation:

Your personal data may be disclosed in accordance with the requirements and legal requirements set by the competent authority.

Subcontractors and service providers

Centria or AIMlearning may use subcontractors and service providers for the technical maintenance of their services, customer service, management and analysis of user data, research, customer communication or the implementation of various campaigns. Your personal data may only be disclosed to subcontractors and service providers to the extent that they are involved in the provision of the services and in the fulfilment of the purposes described in this Privacy Statement.

Such third parties are not allowed to use your data for any purpose other than those described in this privacy statement and determined by Centria. Centria obliges them to keep your information confidential and to ensure an adequate level of data security to protect your personal data.

23.Is the provision of personal data a statutory, contractual or contractual requirement, and is the data subject obliged to provide the personal data and the consequences of not providing the data?

24.Retention period of personal data

ESF funding obliges Centria, as a beneficiary, to store all accounting and other materials related to the project in such a way that it is possible to monitor the use of the support. The data will be stored for the duration of the project and for 10 calendar years from the end date of the project. Data that does not need to be reported or stored will be deleted at the end of the project.

25.Transfer of data outside the EU or EEA

As a rule, the personal data contained in the personal data register is not transferred outside the EU or EEA countries.

However, in some cases, Centria’s services may also be implemented using operators, services and servers located elsewhere, in which case your personal data may be transferred between different countries. Such transfers may include the transfer of personal data outside the EU or EEA to countries whose legislation on the processing of personal data differs from the requirements of Finnish law, such as the United States. In this case, Centria will ensure an adequate level of protection for your personal data, for example, by agreeing on matters related to the confidentiality and processing of personal data as required by law, for example by using standard contractual clauses approved by the EU Commission and otherwise in such a way that the processing of personal data is carried out in accordance with this data protection clause.

26.Data Protection Principles

Personal data is protected by technical measures. Access rights are limited only to those persons whose job description includes the processing of register data.

Centria may also use subcontractors and service providers in the implementation of its services and the processing of personal data. In this case, we ensure through contractual and other arrangements that your personal data is processed in accordance with legislation, good data protection practices and this data protection statement.

28.Rights of the data subject

Data protection rights depend on the basis on which the personal data is processed.

You have the right to receive your own information free of charge. If a person requests more than one copy, the controller may charge a reasonable fee based on administrative costs (Article 15(3) of the EU General Data Protection Regulation).
